Regulatory Framework

The legal requirements for service stations are set out under the:

• Dangerous Substances (Flammable Liquids & Fuels Retail Stores) Regulations 2019 (SI 630/2019)

• Dangerous Substances (Flammable Liquids & Fuels Distribution and Commercial Supply Stores) Regulations 2019 (SI 631/2019)

These regulations came into force on 1 April 2020, repealing and replacing the older 1979 Dangerous Substances regulations.

They govern the licensing of petrol filling stations and fuel storage facilities, and include strict requirements for the provision, cleaning and maintenance of petroleum tanks. The Health and Safety Authority (HSA) is empowered to issue improvement or prohibition notices for non-compliance with risk assessments or licence conditions.
